Welcome to https://yoolk.ninja (the “Site”), a personal portfolio and store run by Capes Jean-marie (“I”, “me”, “my”, or “Yoolk”) as a private individual based in France.

By browsing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or the store.

1. Who I am

I am a private individual, not a registered business. The store is used to occasionally sell items from my own personal collection (collectible toys, art books, original drawings, and similar). I am not a professional retailer, and these sales are non-professional, occasional sales between private parties.

2. The Site and its content

The Site includes a blog, a design and development portfolio, icon sets, photos, and a store. Content is provided for personal viewing and information.

2.1 My own work

Unless stated otherwise, the original content I create — drawings, icon sets, photographs, code, designs, and the look and feel of the Site — belongs to me and is protected by copyright. You may view it for personal use, but you may not copy, redistribute, resell, or use it commercially without my prior written permission. Please ask via the contact page.

2.2 Fan art and third-party characters

Some artwork on the Site is fan art inspired by existing characters from films, TV shows, games, or other works. I do not own any rights to those underlying characters or franchises, and the fan art is shared as a non-commercial creative tribute. If you are a rights holder (or act for one) and want a fan art removed, please contact me at https://yoolk.ninja/contact/ and I will remove it promptly.

2.3 Your use

You agree not to use the Site unlawfully, not to attempt to disrupt or gain unauthorised access to it, and not to scrape or reuse its content beyond normal personal browsing.

3. Portfolio and professional projects

The “Projects” and related sections showcase past work for illustration only. Nothing there is a binding offer of services, a quote, or a guarantee of availability. Any actual freelance engagement would be governed by a separate, individually agreed contract.

4. The store — nature of the sales

All items in the store are second-hand / pre-owned goods from my personal collection, sold as a private individual. They are sold in the condition shown, as described and photographed on each product page.

Because these are non-professional sales between private parties:

• the statutory 14-day right of withdrawal that applies to professional online sellers does not apply; and
• the consumer-law legal guarantee of conformity (which binds professional sellers) does not apply.

Your rights under the French Civil Code (including, where applicable, the warranty against hidden defects) are addressed in Section 9.

5. Product descriptions and photos

Each item is presented with a description and photographs that document its actual condition (wear, defects, completeness, packaging, etc.). I make every effort to describe items honestly and accurately.

The photos form part of the description: by ordering, you confirm that you have reviewed them and accept the item in the condition shown. Colours may vary slightly depending on your screen.

6. Prices and payment

• Prices are shown in euros (€).
• As a private individual, I do not charge VAT; prices are final and no VAT invoice is issued.
• Payment is made through PayPal. Your order is confirmed once payment has been received in full.
• Items remain available to other buyers until payment is completed; adding an item to the cart does not reserve it.
• I reserve the right to cancel an order and refund it in full if an item is no longer available, if there is an obvious pricing or description error, or if I suspect fraud.

7. Orders and acceptance

Placing an order is an offer to buy. A contract is formed only when I confirm the order and/or dispatch the item. You will receive confirmation by email and can follow your order from your account.

8. Shipping and delivery

• Items are shipped via La Poste – Colissimo, with delivery against signature, to France and international destinations.
• Shipping costs are shown before you pay and depend on destination and weight.
• Delivery times are estimates provided by La Poste and are not guaranteed.
• I dispatch items within 3 business days of receiving cleared payment.
• A tracking number is provided so you can follow the parcel.

8.1 International orders, customs and duties

For destinations outside France, any customs duties, import taxes, or handling fees are your responsibility and are not included in the price or shipping cost. Please check your country’s import rules before ordering, including any restrictions on second-hand goods.

8.2 Refusing or not collecting a parcel

Colissimo lets you refuse the parcel on delivery or leave it uncollected. If the parcel is returned to me unopened, I will refund the price of the item, but I may deduct the actual outbound and return shipping costs I incurred. Refused or uncollected parcels that are damaged or opened are handled case by case.

8.3 Risk and loss in transit

Because delivery is made against signature, the tracking and signature serve as proof of delivery. If a parcel is lost or damaged in transit, please contact me promptly so we can open a claim with La Poste together. Keep all packaging and photos in case of damage.

9. Returns, and the warranty against hidden defects

9.1 No returns for change of mind

As these are private, non-professional sales of pre-owned items sold as described, I do not accept returns or exchanges for change of mind, and there is no right of withdrawal (see Section 4).

9.2 Items must match their description

I remain bound to deliver an item that matches its description and photos. If you receive an item that is materially different from what was described, contact me within [e.g. 14 days] of delivery and we will find a fair solution (such as a return and refund).

9.3 Warranty against hidden defects (garantie des vices cachés)

To the fullest extent permitted by law, and as I sell as a private individual, the legal warranty against hidden defects (Articles 1641 et seq. of the French Civil Code) is excluded: items are sold “as-is”, in the condition shown.

This exclusion does not cover any defect that I knew about and failed to disclose: I always disclose known defects in the listing. I describe items honestly and in good faith.

10. Accounts

You can create an account to place orders and track shipments. You are responsible for keeping your login details secure and for the accuracy of the information you provide. You may ask me to close your account at any time via the contact page. I may suspend or close an account in case of misuse or fraud.

11. Liability

I provide the Site “as is” and do not guarantee it will always be available or error-free. To the extent permitted by law, I am not liable for indirect or unforeseeable losses arising from use of the Site. Nothing in these Terms limits liability that cannot be limited by law (including fraud or concealed defects I was aware of).

12. Force majeure

I am not responsible for delays or failures caused by events beyond my reasonable control, including postal strikes or disruptions, customs delays, natural events, or outages.

13. Governing law and disputes

These Terms and any sale are governed by French law. In case of a problem, please contact me first via https://yoolk.ninja/contact/ so we can try to resolve it amicably. If no agreement is reached, the dispute may be brought before the competent French courts, subject to any mandatory rules that protect you in your country of residence.

14. Changes

I may update these Terms from time to time. The version in force is the one published on the Site at the time of your order, shown by the “Last updated” date above.
